Jerry Garcia in Reconstruction, 1979

Since nearly the beginning of the Grateful Dead, Jerry Garcia seemed to always be involved in side projects. The man just loved to play music. In the early days he appears to have just hang around and play with anybody that showed up. Throughout the 1970s he seemed restless, forming and then leaving bands like Old & in the Way, New Riders of the Purple Sage, and Legion of Mary with Merl Saunders. Then there was Reconstruction, one of the most interesting projects in Jerry’s history of interesting projects.

Jerry Garcia’s Middle Finger has done a great job of bringing forth the history of how Reconstruction came to be so I won’t reiterate what’s been said there except to say that Reconstruction was more of John Kahn’s baby than Garcias. His role does seem to be more as a sideman than the driving force/front man he’d be in both the Grateful Dead and most of the other side trips.

The music is a fascinating mix of disco, jazz, and R&B. It is less funky to my ears than the Garcia/Saunders stuff from a few years ago and more jazzy/soulful. I can’t say that I would have wanted Jerry to have stuck with this band as his de facto side trip, but I think its really cool that this band existed.

The lineup consisted of :

Ron Stallings – tenor saxophone, vocals
Gaylord Birch – drums

They did play a few gigs without Garcia, but my focus is only on those shows with him. In total they played 57 concerts all of which were in California with the exception of handful of shows in Colorado. By my count 20 of them were not recorded, or at least there don’t seem to be any recordings in circulation.

Of the shows that do have recordings I have at least one source from each, but I am missing a few things. If anyone has copies of the following and wants to share please let me know.

*The Tamarkin master is fairly brutal, but it’s the only tape which supplies the end
of El Paso and Brokedown Palace. There is some serious tape warble on these tunes,
and there is some very bad tape crackle between songs, which I have removed where
possible without touching the music. Listener beware! For completists only.

*There is a master tape flip at 6:14 of All I Ever Wanted. Very little music seems
to be missing. I have smoothed the cut.

*There is a master glitch at 2:37 of Candyman.

*There are a few level fluctuations in Candyman.

THE CAPITOL THEATER SHOWS — NOV 5-8 1970

For this run of shows at the Capitol Theater Nov. 5-8 the Dead played a single concert each night from Thursday to Sunday. The Capitol Theater’s Village Voice ad for October 1 lists shows “featuring NRPS” at 8:00 PM on November 5th, 6th, 7th & 8th.

11/06/70 is another of the infamous “usher tapes.” Ken Lee worked at the Capitol Theater, and was able to set up to record at the balcony rail. Like 06/24/70 and 11/08/70, this tape is pretty sublime, all 1970 caveats considered. The room ambiance is quickly absorbed into your ear’s psyche, and before long you are feeling very much perched on the lip of the balcony, taking everything in.

I don’t know the name of the guy* who taped the bulk of that show, but he* was
the infamous usher* who’s been mentioned for years. He* did almost everyone who
played there but after a falling out with my friend, his* brother in law, we
never got to dub most of his stash. What was gotten includes several dead, nrps,
janis, tuna, tull, allmans, delaney & bonnie, traffic & j.a. shows. He* would
set up off the balcony with a mike spread. I have no idea what he* used. that
small acoustic portion was mine on a panasonic portable, if memory serves.

What you have as 8/17/70 is the same as what i have. As i mentioned, it was on
one his* tapes with no info. He* didn’t trade so we don’t know where else it
could have been from.

Hi folks, my name is Dave Tamarkin. For many years now I’ve been trying
to correct the base on the subject of 11/6/70 capitol, port chester. This
was my 1st show. I was already quite familiar with existing released lp’s
of the dead. Anyway, I brought a recorder with me not knowing about things
like fresh batteries and how long these guys really play, I only managed
to get a small part of the show. Many years later, I found out that my
friend’s brother in law* was the often mentioned mystery usher* who may have
recorded some shows. He* had a deal with the promoter to tape off the balcony
while tending to his job. His* was the source for many good tapes from there,
including jethro tull, hot tuna, janis joplin, traffic and more. My copy of this
show has the acoustic brokedown palace, followed by ujb to close the set. Also,
if you listen closely, after good lovin, you hear a mention of a break to change
a string, if memory serves. After the break, alligator follows. One show that
night! i walked in about 8:15 and left about 2. And yes, the nrps set does exist
on tape, at least from that night.

Most currently circulating CDRs are partial selections from this show, many exclude the NRPS set entirely and all seem to be missing “Fair Chance To Know”. This version is still missing most of “The Weight”, “Dire Wolf”, and the “Cold Jordan” encore. Other than these defects it represents the complete show in the correct order and excellent sound.

This is a combination of SHNID 28716 and an MP3 source of this medley, presumably from the vault master reels. The MP3 source was released on 5/14/07 as part of David Lemieux’s Tapers Section series at dead.net. The MP3 source was publicly available as a downloadable file for a short period of time, but I no longer have a copy of it. I put this together for a party I threw in August of ’07, and I am working from memory as to its details.

The MP3 source provides a little tuning and the first few notes of New Speedway Boogie, which are missing from all soundboard sources for this date. It also supplies the applause, and the show-ending comments from the stage, including an uncharacteristic outburst from a band member. I can’t say for sure, but I’m almost positive that member was Phil. A friend of mine was at this show, and the next time I see him, I intend to ask him what might have prompted it. If anybody who reads this was there and knows, please contact me. It certainly puts the energy and intensity of what came before in a different perspective.

Oddly, the MP3 source (purportedly from the vault reel) contained a quite noticeable cut in Not Fade Away. While I never got around to a note-by-note comparison of the MP3 source and 28716, the NFA from 28716 seems to be intact, or has been repaired in a way that I can neither hear, nor see in an audio editor.

Also, I seem to recall fixing a brief vocal digisnit in the opening segment of NSB. I wish I could provide exact details, but I didn’t think I was working for posterity at the time.

This show has always stood in the shadow of the Fillmore East gig the following night. In my opinion, it more than holds it own with 5/15, and the portion included here is simply spectacular. It definitely gets my vote for Best Lovelight Ever. I am happy to present thisin a relatively complete form.

Comment:
Phi’s show ending comment mentioned above, “Fuck the pigs!”, can be understood in the context of the time. This show occured 10 days after the Kent State shootings. College campuses across the country had erupted in protests and general strikes. The May tour consisted primarily of Northeastern college campuses. Being that the band had played a free concert at MIT just days before in support of the student protests, there can be little to no doubt that the Dead were caught up in the emotions of the day.
